Job Description

Act as the Legal Business Partner for assigned internal client groups and provide advice and guidance on a broad range of legal and non-legal business issues with the goals of complying with legal requirements and company policies and procedures, and balancing the strategic goals of the company against the legal risks.

1. Participate as a member of the clients' executive committees; provide advice and guidance on a broad range of legal and non-legal business issues so that the Legal function becomes a critical enabler of the business's performance; 2. Work collaboratively with other functions to review company activities to ensure that the activities meet legal and regulatory requirements and the company’s high standards of conduct; the activities will depend on the client groups to which the Senior Legal Counsel is assigned: a. For commercial clients such as Business Units, Marketing and Sales, Key Account Management, or Commercial and Bidding, the activities will include customer-facing promotional activities and materials, distribution arrangements and agreements, tender and bidding materials related to provincial and other levels of drug purchasing, e-commerce and use of digital platforms, donations and other types of fundings to third parties, and vendor arrangements including speakers; b. For regulatory and development clients such as Drug Regulatory Affairs, Market Access, Clinical Development, or Medical Affairs, the activities will include drug listing and registration, clinical trials, interaction with regulators, hospitals and patients, donations, grants and other types of fundings to third parties, policy advocacy, and vendor arrangements, including clinical research organizations; 3. Provide appropriate, prompt and timely legal advice, and recommend paths to the effective resolution of issues and disputes; identify and mitigate legal risks; draft, review and propose modifications to commercial agreements and other contracts; 4. Manage adverse events, patient claims and other adversarial disputes by gathering and reviewing background information, providing exposure assessments, and recommending a path to resolve the events and disputes in a manner that best protects the company's interests; 5. Manage outside counsel in order to achieve the best result at a reasonable cost; 6. Monitor and inform management and peers of legal and regulatory developments that could impact the company's business; provide training to clients in order to ensure compliance with laws and company policies 7. Provide legal support on ad hoc projects, including acquisitions and divestitures, contact by regulators and other authorities, internal and external investigations, and internal process improvements;

Minimum requirements

Degree from an accredited law school or reputable institution of higher education and a qualified to practice law in at least one jurisdiction. Native fluency in Chinese; strong proficiency in spoken and written English. 8-12 years post qualification experience; while prior in-house experience with a pharmaceutical company is strongly preferred, it is not a requirement and prior in-house experience with a multinational enterprise in a regulated industry is desirable; prior direct dealings with government agencies and regulators such as the Ministry of Health, the State Food and Drug Administration, the National Development and Reform Commission or the Administration for Industry and Commerce is highly desirable.
