T h e r ol e w il l b e b a se d i n Shanghai a n d w il l b e r e s po n si b l e f o r building and implementing th e C o m pan y' s Business Conduct i n mainland China , r e p o rt i n g t o t h e head of China L e ga l and Business Conduct.

This role will best be served by an individual with experience working as compliance business partner in pharmaceutical industry in China with knowledge and experiences in: (i) compliance, anti-bribery and anti-corruption within the pharmaceutical industry in China, and with an understanding of the industry codes, and regulations, as well as best practices, applicable in China; (ii) compliance policy and procedures drafting, communication and training; and (iii) supporting expansion of China operations, including with respect to expansion of manufacturing and commercial operations.

Re spo n s i bi l i t i e s w il l i nc l ud e:

  • Establishing and periodically updating policies, procedures, training in relation to interactions with healthcare professionals and other third parties, to ensure they appropriately reflect relevant legal and regulatory requirements.

  • Providing guidance on promotional practices under statutory and regulatory requirements as well as Gilead internal policies.

  • Review of promotional and non-promotional materials relating to commercial and medical events.

  • Ensuring the proper review and documentation of grants, donations and sponsorship activities.

  • Supporting the establishment of a compliance training curriculum for employees and local third party agents, including the Company’s local distributors.

  • S uppo r t in g t h e e x pansi o n o f th e China o r gani z a t io n i n cl u din g in v e s t i g a t in g l o ca l la w s an d r eg u la t io n s pertinent to Business Conduct .

· Supporting the business conduct needs of the Company’s China manufacturing operations including the Shanghai sourcing office and Hangzhou manufacturing plant.

  • Advising on items and projects relevant to business conduct - inc l ud i n g co n sul t in g ag r e em e n t s , cli n i c a l t r ia l ag r e em e n t s , a n d v a r io u s v endo r s e r v ic e s ag r e e men t s - f o r a r a ng e o f i n t e r n a l cl i en t s.

  • Supporting the response t o go v e r n me n t i nq ui r i e s a n d i n v es t i ga t i on s and performing internal investigations.

  • Assisting in managing the review and monitoring of Gilead-organized or Gilead-sponsored commercial and medical events and activities, as well as ensuring that necessary documentation is produced, kept and maintained, and reviewing promotional and non-promotional materials relating to commercial and medical events.

· Maintaining close coordination with attorneys and business conduct colleagues, and individuals within relevant departments (such as Commercial, Finance, Medical Affairs, Regulatory , Clinical Operations and Manufacturing), advancing a positive spirit of partnership and collaboration .

· Demonstrate judgment and integrity in accordance with the highest ethical and compliance standards, including Gilead’s Code of Ethics and Business Conduct policies, and applicable legal and regulatory requirements such as the U.S. Foreign Corrupt Practices Act and Chinese laws.
