PURPOSE and SCOPE OF THE JOB
Purpose: Campaign Legal Counsel provides integrated legal advice and service with a specialization on strategic litigation to further campaign goals and interests in Greenpeace East Asia offices, including Beijing, Hong Kong, Taipei and Seoul. Campaign Legal Counsel plays a driving role in employing strategic litigation to promote environmental justice and mitigate climate change, and to proactively and reactively defend GPEA and its employees from legal attacks.
Scope of the Job: Develop proactive legal strategies and tactics for strategic litigation, litigate cases on environmental issues, and seek legal opportunities to advance Greenpeace campaign goals, develop and promote the best practice of campaign legal work, train campaign teams to improve legal campaign knowledge, and proactively and reactively defend GPEA and its employees from legal attacks.
RESPONSIBILITIES:
- Develop legal strategies and legal tactics by using laws and legal proceedings to promote Greenpeace campaigns. Work closely with GPEA campaign teams to develop strategic legal elements of campaign projects.
- Carry out the litigation related work in line with the developed legal strategies and legal tactics; develop, advise and follow litigate cases including but not limited to environmental tort case, administrative litigation, class action, climate litigation, public interest litigation etc., which align with Greenpeace mission and the its campaign goals. Take the lead on all aspects of the strategic litigation work.
- Strengthen the partnership with external lawyers and legal community to deliver meaningful results for the environment, health and communities in East Asia jurisdictions; cultivate new allies and coalition partners to conduct legal campaign work and file strategic litigation cases; create synergy with the campaign under the legal framework of national law and international law. Ensure external lawyers and partners are provided adequate instruction, information and professional legal service to better serve the goal of strategic litigation and Greenpeace campaign.
- Serve as Spokesperson for the strategic litigation cases whenever necessary.
- Provide legal advice and legal review on Greenpeace campaign-related publications and communications materials. Conduct legal risk assessments of campaign activities that may pose legal risk and advise on how to mitigate risk without compromising campaign impact.
- Knowledge management: Develop and manage information on all jurisprudence favourable to Greenpeace as well as proactive litigation conducted by Greenpeace or others. Maintain and develop a legal case database; and track the updated laws, regulations and cases valuable to Greenpeace campaign work.
- Provide legal support in the event that activities result in legal consequences,and identify opportunities to turn such threats into platforms to advance campaign goals. Lead and manage the development and implementation of legal strategies for major pending litigation involving GPEA entities.
Work environment
Occasional or need-based travel is required.
Preferred Candidate Profile
(1) Bachelor's Degree in Law; International education background with Master's Degree of law in both civil law system and common law system is preferred; major in international law or environmental law or public law (e.g. administrative law, criminal law) is an advantage.
(2) At least 3 years of legal practice experience in litigation as an attorney or in-house lawyer. (3) Litigation experience in environmental cases is preferred but not required.
(4) Ability to think analytically and strategically
(5) Identification with Greenpeace goals and supportive of Greenpeace values
(6) Self-motivated and good team spirit
(7) Be able to work under stress and willing to travel

Bar qualification/Be qualified to practice law.
