Job Description

Support the success of De Beers’ downstream businesses, specifically Forevermark and De Beers Jewellers in PRC by the provision/procurement of legal advice on all commercial affecting its businesses as follows:

  • Support the group’s downstream businesses in relation to commercial and IP legal issues that affect the execution of their business plans;
  • Create awareness of, and communicate changes to, commercial and IP law matters affecting the group’s downstream businesses in PRC;
  • Conduct relevant legal research for the group’s downstream businesses;
  • Manage the provision of legal services by external lawyers and law firms in PRC a cost-effective manner;
  • Draft, review and negotiate (or supervise external lawyers drafting) agreements to document commercial transactions and relationships for De Beers’ downstream businesses.
  • Support and implement systems, procedures and strategies for managing legal risks in relation to IP and commercial transactions and relationships, including managing the Forevermark and De Beers Jewellers contracts.
  • Assist in designing, implementing and improvement of standard operational procedures and precedent agreements for use in PRC.
  • Train clients in assessment of and decision-making in relation to legal risk in commercial transactions (including IP risks) and relationships for De Beers’ downstream businesses.

  • Report on a regular and consistent basis in relation to progress of work, costs and legal matters

Financial:

  • Contribute to the development of the budget
  • Monitor your costs against budget and either address, or advise your manager of, any variances of note
  • Identify any opportunities for improved cost management and either address these, or raise them with your manager, as appropriate

Work Processes:

  • Fully understand the policies, processes and systems which apply to your work and within these
  • Identify any issues around these that interfere with your ability to complete work or meet the plan/strategy. For processes within your authority, make the required changes. For others, escalate these issues to seek action and / or look for alternative solutions

Qualifications

Knowledge of

  • Commercial law (licensing and contracts)
  • IP law (some experience required)
  • Commercial understanding of consequences of legal scenarios/decisions
  • Demonstrated competence in communicating legal concepts in business-friendly terms
  • Demonstrated legal expertise with a willingness to develop complimentary business skills
  • Ideally, prior experience both in private practice (with a reputable law firm) and in an In-House role/secondment.

Qualifications

  • Qualified mid-level – senior associate with experience in:
  • Commercial law - drafting/negotiating commercial contracts and licences; and
  • Non-contentious IP law, particularly branding (brand clearance and trade mark/designs portfolio management are not part of this role).
  • Admitted to PRC Bar/PRC legal qualification
  • Graduated from a reputable law school in PRC, and any overseas educational background is a plus
