The Challenge

In today’s business environment, the protection of innovation and intellectual property (IP) in China is critical to the success of many business strategies. Consequently, not only the creation of relevant IP positions, but also the leveraging, through appropriate licensing and litigation, is essential. In view of DSM’s extensive business presence in China, we are looking to hire an experienced, senior patent attorney who can effectively interact with business, IP and legal professionals in order to provide creative, practical and effective IP advice. Currently, the workload is expected to be split between IP creation (e.g., prep and pros) and leveraging IP (evidence collection, litigation, agreement drafting, etc.). The candidate is to be based in either Shanghai or the Netherlands as the primary work location, but at least quarterly travel to other site (e.g., non-primary work location) on a regular basis is essential and required.

The Position

Creating and executing IP strategies in China for both China-based businesses as well as US-, Europe-based businesses operation in China, in close coordination and alignment with business and IP colleagues outside China.

Drafting and prosecuting patent applications and advising on myriad patent issues including freedom to operate studies.

Advising business and IP management regarding patent invalidation cases before the Chinese Patent Office.

Advising business and IP management regarding leveraging patents, especially with regard to evidence collection as well as preparing and conducting judicial and administrative patent infringement cases in China. Experience in IP licensing aspects and collaborations is an advantage.

As many DSM business have activities both in- and outside China, the candidate will need to work closely with patent attorney colleagues outside China on many of his/her tasks.

The Ideal

Be qualified as Chinese patent attorney, with at least 10 years post-qualification experience in the responsibilities listed above. Private practice or inhouse can equally apply.

Hold a university (or desirably) an advanced degree in a relevant scientific field (e.g., Chemistry, Materials Science, Engineering, etc.…).

Have excellent communication skills including spoken and written proficiency in English and Chinese.
