Senior Legal Counsel BMW Group China legal affairs department (AJ-CN)

Description
A.Job Scope:
a. Responsible for advising on and managing the legal affairs for BMW Group China (market sales volume 600.000+ units), with particular responsibility for providing expert legal advice to BMW China Automotive Trading Limited (NSC), BMW China Services Limited (BCS), BMW Automotive Finance (China) co., Ltd. (AFC), Herald International Financial Leasing C., Ltd. (Herald) – altogether referred to as “BMW China” - its executives and management on business critical, corporate, strategic, high risk exposure, regulatory, compliance, public policy, and day-to-day, corporate, commercial, contract, operational, legal compliance and litigation related legal matters.
b. Responsible for drafting, negotiating and advising on R&D projects, regulatory framework, commercial agreements, arrangements and settlement of litigation/disputes at best value and least financial risk to BMW Group.
c. Responsible for planning, steering and coordinating the legal budget requirements for external legal advice for BMW China (> 1 Mio. RMB/year); selecting, steering, coordinating and monitoring external legal counsel, negotiating fee arrangements and monitor spending.
d. Pro-actively protect overall BMW Group China budget and business from legal, compliance, financial, operational and commercial risks arising from disputes, litigation, contractual/legal liabilities and legal compliance risks.
e. Pro-actively protect overall BMW Group China investment from legal, compliance, financial, operational and commercial risks arising from disputes, litigation, contractual/legal liabilities and legal compliance risks.

B.Responsibility:
a. Direct responsibility for leadership of the provision of legal services for BMW Group in mainland China, with regional and global responsibility for BMW China Automotive Trading Ltd., BMW Automotive Finance (China) Co., Ltd, BMW China Service Ltd., Herald International Financial Leasing Co., Ltd., Herald Hezhong (Beijing) Automobile Trading co., Ltd.
b. Leadership of the provision of legal services on Sales, Distribution, Litigation, Financial Services, Treasury, Research and Development, Purchasing and Supplier network AP in China; expert legal advice to BMW AG on all CN law specific questions and projects. Leadership for the provision of expert strategic corporate and commercial legal advice, including compliance, company secretarial and financial services regulation to board members and senior management in China, BMW AG, collaborations.
c. Proactive coordination of legal services with BMW Brilliance Automotive Ltd. legal department, expert strategic advice to BMW AG.
d. Proactively coordinating and influencing key stakeholders both external and internal to ensure that decisions are in line with legal requirements, corporate strategy; including responsibility for escalating key strategic issues to senior management and board members, as appropriate.
e. Responsibility for the prevention of legal and reputational risk to the BMW Group in China. Case by case intervention in matters of special economic and corporate/political relevance.
f. Attending as AJ-CN / BMW Group representative at internal committees, external organisations as required. Regular reporting to AJ.

Qualifications and Experience
A.Education:
a. Bachelor of Laws or Juris Doctor, and
b. Chinese national bar exam, and
c. International Master of Laws obtained in an English speaking environment (or equivalent). US bar exam is not required, but a benefit.

B.Work experience, Leadership experience:
a. Five to seven years of legal work experience in a corporate legal environment or top tear law firm is required at a minimum. Legal experience with another motor vehicle distributor/manufacturer, tech company or financial services company or advising clients in the automotive field is desired, but not required.
b. Ability to influence and communicate effectively, demonstrable leadership experience desired, and the ability to establish and maintain strong and effective working relationships with internal and external contacts.

C.Additional skills: special skills / technical ability etc.:
a. Broad knowledge of PRC law, with particular focus on general corporate, automotive, IT, telecommunication, e-commerce, anti-monopoly/antitrust, competition, contract, litigation, consumer protection, privacy/cyber-security as well as criminal, corporate governance, commercial, debtor/creditor securities, finance, marketing and advertising, banking, contracts, torts and negligence, criminal, insurance, distribution and public law.
b. Excellent verbal and written communication skills.
c. Excellent Chinese and English language skills, verbal and writing, profound negotiation level.
d. Ability to work under high pressure.
e. Profound negotiation skills.
f. Strong and self-confident personality.
g. Experience and willingness to work in an international environment/team.
h. Word and MS office software.
i. Excellent and (due to various responsibilities) broad knowledge of PRC law.
j. Ability to adapt to different and new practice areas as required.
