-Provides legal advice and legal service on legal regulatory prevention topics for Trucks & Buses businesses in Greater China.
-Provides legal advice and legal service regards all topic in connection with Daimler’s technical compliance management system (“tCMS”).
Main task
1.Legal advice
-Provides legal advice and legal service on legal regulatory prevention topics for Trucks & Buses businesses in Greater China. Legal regulatory prevention includes all product related legal topics, in particular product development, emission, certification, product safety, new technologies e.g. autonomous driving.
-Provides legal advice and legal service regards all topics in connection with Daimler’s technical compliance management system (“tCMS”), and takes an active role in cross-divisional tCMS Clearing Teams.
-Provides legal advice and legal service to: Daimler local legal teams in Greater China, Daimler Legal HQ, Daimler Legal Regions, CEOs, functional heads of business units and other Daimler internal stakeholders (in particular R&D, homologation, certification).
-Drafts, reviews, negotiates and advises on all kind of legal documents, provides legal memos and opinions.
-Observes the development of legal developments and trends, in particular: legislation, jurisdiction, public authorities and government agencies. Takes care of proactive communication with stakeholders.
-Provide guidance in grey areas (in terms of legal requirements and/or internal guidelines).
2.Legal risk management
-Provides legal risk management strategy and aligns the strategy with the relevant stakeholders to enable Daimler and its employees to comply with legal requirements, including laws and government regulations.
-Develops programs, processes and measures for legal risk mitigation. 3.Authorities
-Acts as point of contact for investigating authorities (prosecutors, stock exchange commissions, government authorities etc.), in alignment with the local legal teams and Daimler HQ.
-Advises employees and management on rights and duties.
-Represents Daimler in meetings with authorities.
4.Policies and Guidelines
-Designs, develops and continuously improves: tCMS related policies, guidelines and standard operating procedures, and provide support in interpretation and implementation.
5.Global and regional initiatives
-Drives the implementation of Daimler global and regional initiatives on legal regulatory prevention and tCMS for Greater China.
6.External legal service
-Selects, manages and supervises external lawyers. Ensures high quality of external legal support in an effectively and efficiently manner, including cost-efficiency.
7.Training & best practice sharing
-Develops training concepts and provides training on legal/tCMS relevant topics to: Daimler local legal teams at Greater China, CEOs, functional heads of business units and other Daimler internal stakeholders.
-Provides knowledge sharing and best practice sharing towards Greater China legal teams, Daimler Legal HQ and Daimler Legal in other regions.
