Job Description

Job Summary:

This role will have responsibility for all legal matters in Taiwan and Hong Kong (both Consumer and KCP), including providing strategy and legal excellence to the accomplishment of the objectives of the Taiwan and Hong Kong teams to ensure compliance with all applicable laws and regulations. The successful candidate will be the business partner to the Managing Directors of Taiwan and Hong Kong, and be the representation of legal capability within the Taiwan and Hong Kong Leadership Teams.

  • Reporting to : VP and Chief Legal Counsel, APAC (based in Singapore)
  • Supervisor to : Paralegal (based in Taiwan)
  • Key Business Partner to : Managing Director - Taiwan, Managing Director - Hong Kong and General Manager – Taiwan and Hong Kong KCP

Job Responsibilities:

1. Develop, together with line manager, and execute legal strategy for geographies covered with clear priorities and committed targets, working within matrix network of supporting country / regional Legal team members.

2. Provide legal advice, legal leadership, strategy and legal risk management in all legal matters in the geographies covered, including:

  • Employment: Work closely with HR to ensure country practices, polices and work rules comply with relevant labour regulations and to maintain harmonious relationship with Union, advise on employment disputes.
  • Marketing claims: Provide guidance, advice on product developments and approval of marketing claims and marketing materials.
  • Competition law: Advise on pricing related issues, and competition law related issues including interaction with competitors and trade associations.
  • Intellectual Property: Work closely with APAC IP Counsel to advise on and manage IP disputes including counterfeiting and infringement.
  • Contracts: Review and participate in the negotiation, review and approval of material contracts.
  • Disputes / Litigation: Lead and manage legal disputes and marketing claim challenges.
  • Participate in negotiation and advice and be involved in preparation of documentation for mergers, disposals, restructures, strategic alliances, acquisitions of companies (if any).

3. Elevate legal issues of importance to senior legal leaders and actively participate in knowledge sharing.

4. Work in partnership with APAC Compliance & Ethics Leader to drive compliance in Taiwan and Hong Kong including driving compliance trainings and initiatives.

5. Manage outside counsel in geographies covered.

Qualifications and experience

  • Law degree and qualification to practice law in Taiwan or Hong Kong, with a minimum of 15 years’ experience) ideally within an international company and law firm. Additional degree / education from English speaking university e.g. UK or United States would be a plus.
  • Mixed of law firm and in-house experience.
  • Leadership experience gained preferably with an international or CPG company Fluency in English and Chinese (both oral and written).
  • Prepared to travel within Taiwan and Hong Kong, and APAC / globally as needed.

  • Commercial acumen, solutions orientated, pragmatic but creative legal practitioner
  • Integrity – must lead by example and willing to take unpopular decisions if necessary
  • Influence – possess sufficient maturity to be part of the TW and HK country leadership teams, and be able to influence and guide the MDs of TW and HK in legal and compliance matters
  • Capable of rational and analytic thinking leading to workable solutions which demonstrate sound and unbiased judgment
  • Extensive experience drafting and negotiating agreements
